1. Who you are contracting with
These Terms & Conditions ("Terms") are a binding agreement between you and SparkType.ai("SparkType.ai", "we", "us") governing your access to and use of our website, prompt builder, lens features, and related services (the "Service").
2. Acceptance
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are at least the age of majority in your jurisdiction or, if using on behalf of an organisation, that you have authority to bind that organisation.
3. The Service
SparkType.ai provides a prompt-building tool and a library of "lenses" that help you pressure-test ideas with large language models. Outputs are generated by third-party AI models and may contain inaccuracies. The Service is provided on an "as available" basis; we do not guarantee uninterrupted or error-free performance.
4. Acceptable use
You must not, and must not permit others to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Generate or distribute illegal content, hate speech, harassment, malware, deepfakes, or content that infringes intellectual property or privacy rights.
- Attempt to jailbreak, reverse engineer, scrape, probe, or interfere with the security of the Service.
- Resell or redistribute the Service or circumvent technical limits (such as plan quotas).
- Use the Service to provide regulated professional advice (medical, legal, financial) without independent qualified oversight.
5. Your content and outputs
You retain rights in the prompts and inputs you submit ("Inputs") and, subject to these Terms and the underlying model providers' terms, in the outputs generated for you ("Outputs"). You grant SparkType.ai a limited licence to host, process, and transmit your Inputs and Outputs solely to operate, secure, and improve the Service. You are responsible for your Inputs, for verifying the accuracy of Outputs before relying on them, and for ensuring you have the rights to any content you submit. We may remove content or restrict accounts that violate these Terms, and we operate a takedown process for rights-holder complaints — contact hi@sparktype.ai.
6. Intellectual property
The Service, including its software, design, branding, lens library, and documentation, is owned by SparkType.ai and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. All rights not expressly granted are reserved.
7. Accounts
You must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
8. Subscriptions, payments and Merchant of Record
Paid plans are billed in advance on a recurring monthly or yearly basis until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries related to payments and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms, available at https://www.paddle.com/legal/checkout-buyer-terms.
You can cancel a subscription at any time from the customer portal; you keep access to paid features until the end of your current billing period. Refunds are handled in line with our Refund Policy.
9. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated/serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends and we may delete account data after a reasonable export window.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Outputs are accurate, complete, or suitable for any particular purpose.
11. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service will not exceed the fees you paid to Paddle for the Service in the twelve (12) months before the event giving rise to the claim. We will not be liable for any indirect, consequential, special, incidental, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability that cannot lawfully be excluded (such as for fraud or death/personal injury caused by negligence).
12. Indemnity
You will indemnify and hold SparkType.ai harmless from claims arising out of your Inputs, your use of Outputs, your violation of these Terms, or your violation of any law or third-party right.
13. Changes
We may update these Terms from time to time. We will notify you of material changes through the Service or by email. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws applicable at SparkType.ai's principal place of business, without regard to its conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer law gives you the right to bring proceedings in your country of residence.
